Code of Ethics Update: Immediate Change to Standard of Practice 10-5
NAR has amended, effective immediately, Standard of Practice 10-5 as follows:
REALTORS®, in their capacity as real estate professionals, in association with their real estate businesses, or in their real estate-related activities shall not harass any person or persons based on race, color, religion, sex, disability, familial status, national origin, sexual orientation, or gender identity.
As used in this Code of Ethics, harassment is unwelcome behavior directed at an individual or group based on one or more of the above protected characteristics where the purpose or effect of the behavior is to create a hostile, abusive, or intimidating environment which adversely affects their ability to access equal professional services or employment opportunity. (Adopted and effective November 13, 2020, Amended 1/23 and 6/25)
This new language provides a more specific definition for “harassment,” which now aligns with the definition in NAR’s Member Code of Conduct. This change also focuses Article 10 on instances where REALTORS® operate in their professional capacity, which is consistent with similar ethical requirements imposed by other large trade associations. Lastly, this change is intended to reduce the risk to state and local associations and their volunteer members when enforcing Article 10.
NAR states that it remains deeply committed to fair housing and equal treatment for all consumers. The Code of Ethics continues to hold REALTORS® to the highest ethical and professional standards.
